1. General and definitions
These terms of use ("Terms") apply to your use of the website canaflight.com ("Site") and the coordination service offered on it ("Service"), operated by CanaFlight ("we", "CanaFlight"). Any use of the Site or Service, including filling out the eligibility questionnaire, constitutes full acceptance of these Terms. If you do not agree to any of these Terms, please refrain from using the Site and Service.
This document is written for convenience in one grammatical form and refers equally to all genders.
2. Who operates the service
The Service is operated by [full business name and registered business/company number — to be completed], a business operating in Israel. Full contact details appear in Section 15 below. These details are provided here in accordance with the disclosure obligation under the Consumer Protection Law, 5741-1981.
3. The nature and limits of the service
CanaFlight is an administrative coordination and support service only. Our role is to receive the details you provide in the eligibility questionnaire, forward them for review by a doctor licensed in Greece, and assist with logistical coordination with the doctor and with licensed pharmacies in Greece.
CanaFlight is not:
- A clinic, medical institution, or provider of any medical services;
- A pharmacy, and does not sell, manufacture, supply, or hold any cannabis products;
- A law firm, and does not provide legal advice.
All information on the Site, including the full guide, is for informational purposes only and does not constitute medical, legal, or other advice. If you need such advice, please consult a qualified professional.
4. No guarantee of outcome
CanaFlight does not undertake, promise, or guarantee that any doctor will approve your request, issue a prescription, or that an issued prescription will be accepted at a particular pharmacy. Presenting a medical condition as one "commonly considered" by doctors in Greece (for example chronic pain, insomnia, anxiety, or migraines) does not constitute a promise of approval — the medical decision is made independently and exclusively by the treating doctor, based on their professional judgment and the law applicable in Greece.
5. Independent status of the doctor and pharmacy
The doctors referred through the Service and the pharmacies mentioned on the Site are licensed, independent parties operating in Greece under Greek law, and are not employees, agents, partners, or joint venturers of CanaFlight. CanaFlight is not a party to the medical decision, to the doctor–patient relationship, or to the purchase transaction at the pharmacy — these relationships are governed by Greek law. Nonetheless, CanaFlight works to select and coordinate with licensed, properly authorized parties, and does not disclaim liability for its own negligence in selecting them.
6. Your responsibility for legal and airline compliance
Medical cannabis, even when lawfully purchased in Greece, is subject to strict laws regarding use, possession, transport, and export/import. On the Site and in the full guide we have compiled information on the most important rules known to us, including: the requirement for prior approval from the Greek medicines authority (EOF) to bring cannabis into Greece; the absolute prohibition on bringing cannabis into Israel; and the restriction of use to a private place of lodging only. You confirm that you have read and understood this information, and you bear sole responsibility for complying with all applicable law, including customs, import-export law, and airline regulations, in Israel, in Greece, and in any transit country. CanaFlight is not liable for any delay, confiscation, fine, detention, or criminal proceeding resulting from your decisions regarding transport and customs. Nothing in this section derogates from any non-waivable right under law.
7. Product prices at the pharmacy
Product prices shown on the Site (for example, a price range per gram) are estimates only, based on independently collected information, and are not binding on any pharmacy. CanaFlight does not control availability, product mix, or actual pricing at the pharmacy, and is not liable for price differences, stock shortages, or discontinuation of a particular product — except to the extent these arise from CanaFlight's own negligence or misrepresentation.
8. Regulatory changes and service discontinuation
Medical cannabis regulation in Greece and Israel is a dynamic field (for example: legalization in Greece since 2017, and the start of actual pharmacy dispensing only in February 2024). If a change in law, regulation, or enforcement in Greece or Israel temporarily or permanently prevents the Service from being provided, CanaFlight will not be liable for the non-provision of the Service under these circumstances, but will act to refund the proportional payment for requests not yet processed, or to grant credit for a future service, at your choice.
9. Limitation of liability
To the extent permitted by law, CanaFlight's total liability to you in connection with the Service, on any grounds whatsoever, shall not exceed the amount you actually paid for the specific request that is the subject of the claim. This limitation does not apply to, and does not derogate from, liability for gross negligence, fraud, or bodily injury, to the extent such liability cannot be excluded under law. CanaFlight is not responsible for the clinical efficacy, side effects, or drug interactions of any cannabis product — that responsibility rests solely with the treating doctor and the dispensing pharmacist.
10. Accuracy of information and indemnification
You are solely responsible for the accuracy, completeness, and currency of all information you provide in the eligibility questionnaire, including identity details, medical condition, and the existence of prior prescriptions. CanaFlight and the treating doctor act in good-faith reliance on the information provided. If false or misleading information is provided (for example, regarding age, medical condition, or identity), CanaFlight may refuse or discontinue the Service and refuse a refund — all subject to any rights that cannot be waived under law — and you undertake to indemnify CanaFlight for any damage, claim, or regulatory proceeding arising from such misrepresentation.
11. Eligibility and service termination
The Service is intended for individuals aged 18 and over only. Using the Service constitutes a declaration that you are at least 18 years old. CanaFlight may refuse to provide the Service, discontinue it, or cancel an approved request, if it is found that the user is a minor or provided false identity information.
12. Cancellation and refunds
The full cancellation and refund terms, including the distance-sale cancellation right under Section 14c and the consequences of cancellation (including the cancellation-fee cap) under Section 14e of the Consumer Protection Law, 5741-1981, are detailed in full in our cancellation and refund policy, which forms an integral part of these Terms.
13. Intellectual property
All rights in the Site, its design, content, and source code belong to CanaFlight or its rights holders, and may not be copied, reproduced, or distributed without prior written consent.
14. Governing law and jurisdiction
The contract between you and CanaFlight is governed by Israeli law, and the courts of competent jurisdiction in Israel have exclusive jurisdiction. Nothing herein derogates from the law applicable to the doctor–patient relationship or the purchase transaction at the pharmacy in Greece, which are governed by Greek law and to which CanaFlight is not a party.
15. Changes to these terms and contact
We may update these Terms from time to time; the version published on the Site at the time of use is the binding version.
